The 2024 Legislative Session ends on May 9th, 2024 ... at 5PM. We have a total of SIX Legislative Days left to get done what needs to get done!!! How does this impact School Choice?
ESA / ESTA - SUPREME COURT LAWSUIT: Well ... there is a SC Supreme Court lawsuit challenging Ellen Weaver's 100% Government Run ESA / ESTA. Oral arguments did not go well back on March 6th ... and everyone we have spoken to expects the SC Supreme Court to rule the program UNCONSTITUTIONAL ... for the third time since 2020!!!
SC Supreme Court ruling come out each week on Wednesday mornings ... but if nothing is done and an UNCONSTITUTIONAL ruling comes out after May 9th ... the ESA / ESTA program will be shut down and SC will have ZERO private school choice. Our experience is the monied special interest are ok with this result. Families suffer, but Ellen Weaver's friends line their pockets.
S285 - PACE/ACE SCHOLARSHIP BILL: Since SC Superintendent of Education Ellen Weaver and her allies seem to actively oppose "real" school choice and have refused to publicly endorse S285, the PACE / ACE Scholarship Bill ... and the SC Freedom Caucus Leadership favor the ESA / ESTA given their conflicted financial interest (i.e., the Morgan family Palmetto Fortis business) ... #FollowTheMONEY ... SC House Leadership faces a quandary. If they do nothing and the ESA / ESTA is ruled unconstitutional after May 9th, SC House Leadership will be at fault for ZERO private school choice in South Carolina.
What needs to be done? Delay, delay, delay is what elected officials do. SC House Leadership has done just that on real school choice. They have delayed the school choice question until the very end ... again ... with just 6 legislative days left.
What are Leadership's options? #1 Pass S285 ASAP, As-Is so we have it in law immediately. #2 Add S285 to the Sine Die Resolution so it can be taken up AFTER the May 9th, 2024, deadline.
It will be a very interesting next 6 legislative days at the SC Statehouse as it relates to School Choice. Do any of the "sides" (for lack of a better term) in Columbia care about our K-12 kids ... or is it all about them and their respective monied special interest.

DEFINITION: The Sine Die Resolution is the day that the South Carolina legislature adjourns for the year, which is May 9, 2024. Only legislation identified in the Sine Die Resolution can be considered or acted upon after this date. Bills have until Sine Die to be signed into law.
